1. Acceptance of Terms

By accessing or using the Nuklex web application or mobile application (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Nuklex is a fitness and workout tracking platform that allows users to log workouts, track body measurements and progress, create training plans, and connect with personal trainers. The Service is provided by Nuklex ("we", "our", or "us").

3. Account Registration

To use the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must notify us immediately of any unauthorized use of your account. We are not liable for any loss arising from unauthorized use of your account.

4. User Roles

The Service supports the following user roles:

  • Athletes: Individual users who track their own workouts and progress
  • Personal Trainers (Private): Trainers who manage individual clients
  • Personal Trainers (Gym): Trainers associated with a gym who manage gym clients

Personal trainers who manage clients acknowledge that they are responsible for the appropriate use of their clients' data and must have their clients' consent to access their fitness information.

5. Subscriptions and Payments

Certain features of the Service may require a paid subscription. Subscription fees are billed in advance on a recurring basis. You agree to pay all fees associated with your chosen plan.

Subscriptions automatically renew unless cancelled before the end of the current billing period. You may cancel your subscription at any time through your account settings.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Share your account credentials with others or allow others to access your account
  • Upload content that is offensive, harmful, or infringes on the rights of others
  • Attempt to gain unauthorized access to the Service or its systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated means (bots, scrapers) to access the Service without our written permission
  • Reverse engineer, decompile, or disassemble any part of the Service

7. Intellectual Property

The Service and its original content, features, and functionality are owned by Nuklex and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

You retain ownership of any content you upload to the Service (such as workout data and progress photos). By uploading content, you grant us a limited license to store and display that content as necessary to provide the Service.

8. Health Disclaimer

The Service is intended for fitness tracking and informational purposes only. It is not a substitute for professional medical advice, diagnosis, or treatment. Always consult a qualified healthcare provider before starting any exercise program or making changes to your fitness routine.

We do not guarantee any specific fitness results from using the Service. You exercise at your own risk and are solely responsible for your health and safety during physical activity.

9. Limitation of Liability

To the maximum extent permitted by law, Nuklex shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, arising from your use of the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

We may terminate or suspend your account at any time, with or without notice, for conduct that we determine violates these Terms, is harmful to other users or the Service, or for any other reason at our sole discretion.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease, and your data will be handled in accordance with our Privacy Policy.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.
